Playing by the Rules
The Virginia laws have established several rules that home growers have to respect in order to grow their marijuana legally and safely. Adhering to the rules below is absolutely mandatory. Not doing so can result in fines and misdemeanor charges:
1. Virginia residents can grow no more than 4 plants per home (not per individual in the home)
2. Plants must be planted away from easy view from the street or public way without the use of binoculars or visual aids
3. The grower must take reasonable precautions to ensure that anyone under the age of 21 cannot reach the plant(s)
4. Each plant should be labeled with a tag that includes the following:
a. The grower’s name
b. The grower’s driver’s license or state ID number
c. A declaration that the product is for personal use only as authorized by law
Of course, there’s a little catch in all of this that makes home cultivation quite complicated! While it is legal to grow up to four plants at a private residence, it is not legal to buy or sell seeds in Virginia. This issue means that some Virginians that want to grow at home might consider alternatives, including the very much illegal act of transporting plants or seeds across state lines.
While some seed banks and growers have conducted seed ‘giveaways,’ this alternative option also enters into a gray area within the law and could create legal complications for potential home growers.
No Selling, Some Sharing
So, you’ve grown your marijuana plants at home? Can you sell the marijuana to friends? Absolutely not. No Virginian can sell or possess with the intent to sell marijuana in the Commonwealth. Anyone who does will be subject to misdemeanor or felony charges, depending on the volume of marijuana involved in the case.
Virginians are allowed to share, to a degree. Legalization of marijuana in Virginia included language that allows for “adult sharing.” This means a citizen of the Commonwealth can transfer one ounce or less of their homegrown marijuana to another person in Virginia who is 21 years or older, as long as they receive no payment in return.
What doesn’t qualify as adult sharing? Adults in Virginia cannot:
give away marijuana contemporaneously with another reciprocal transaction between the same parties
give a gift of marijuana offered or advertised in conjunction with an offer for the sale of goods or services
give a gift of marijuana that is contingent upon a separate but still reciprocal transaction for goods/ services
