While it is legal to grow up to four plants at a private residence, it is not legal to buy or sell seeds in Virginia. This issue means that some Virginians that want to grow at home might consider alternatives, including the very much illegal act of transporting plants or seeds across state lines.
While some seed banks and growers have conducted seed ‘giveaways,’ this alternative option also enters into a gray area within the law and could create legal complications for potential home growers.
No Selling, Some Sharing
So, you’ve grown your marijuana plants at home? Can you sell the marijuana to friends? Absolutely not. No Virginian can sell or possess with the intent to sell marijuana in the Commonwealth. Anyone who does will be subject to misdemeanor or felony charges, depending on the volume of marijuana involved in the case.
Virginians are allowed to share, to a degree. Legalization of marijuana in Virginia included language that allows for “adult sharing.” This means a citizen of the Commonwealth can transfer one ounce or less of their homegrown marijuana to another person in Virginia who is 21 years or older, as long as they receive no payment in return.
What doesn’t qualify as adult sharing? Adults in Virginia cannot:
give away marijuana contemporaneously with another reciprocal transaction between the same parties
give a gift of marijuana offered or advertised in conjunction with an offer for the sale of goods or services
give a gift of marijuana that is contingent upon a separate but still reciprocal transaction for goods/ services
