Virginia Telemedicine & Medical Cannabis Compliance Policy

(Privacy Policy, Terms of Use, Mandatory Disclosures, and Legal Notices)

Effective Date: January 1, 2026

This Virginia Telemedicine & Medical Cannabis Compliance Policy (“Policy”) governs all access to and use of websites, digital platforms, telemedicine systems, and related services operated by Auren LLC (“Auren,” “we,” “us,” or “our”). This Policy also governs all medical cannabis evaluations and related services provided by Auren in the Commonwealth of Virginia.

By accessing or using any Auren website, telemedicine platform, or medical cannabis evaluation service, you acknowledge, understand, and agree to be legally bound by this Policy. If you do not agree, you must immediately discontinue use of all Auren services.

1. Scope and Applicability

This Policy applies to:

  • All Auren websites, portals, and digital properties

  • All telemedicine services are provided to patients located in Virginia

  • All medical cannabis evaluations conducted by Auren‑affiliated physicians

  • All communications, data transmissions, and interactions with Auren

  • All individuals who access or use Auren services (“you,” “your,” or “patient”)

This Policy incorporates and supersedes all prior versions of Auren’s Privacy Policy, Terms of Use, and telemedicine disclosures.

2. No Medical Advice; No Provider–Patient Relationship Outside Formal Evaluation

Information presented on Auren websites, digital platforms, or social media pages is provided solely for general informational and educational purposes. Such information:

  • Does not constitute medical advice

  • Does not establish a provider–patient relationship

  • Should not be relied upon for diagnosis, treatment, or medical decision‑making

A provider–patient relationship is established only during a formal medical evaluation conducted by a licensed physician.

3. Telemedicine Services: Mandatory Virginia Disclosures

Auren provides medical services via telemedicine in accordance with:

  • Code of Virginia § 38.2‑3418.16 (Telemedicine Services)

  • Code of Virginia § 54.1‑3303 (Prescribing via Telemedicine)

  • Virginia Board of Medicine telehealth regulations

  • Virginia Cannabis Control Authority (CCA) requirements

By using Auren’s telemedicine services, you expressly acknowledge and agree to the following:

3.1 Nature of Telemedicine

Telemedicine involves the use of electronic communications, including but not limited to:

  • Real‑time audio and video

  • Electronic transmission of medical records

  • Digital images and documentation

  • Remote clinical assessments

3.2 Consent to Telemedicine

By accessing Auren’s telemedicine platform, you provide informed consent to receive healthcare services via telemedicine. You may withdraw consent at any time; however, withdrawal may prevent completion of your evaluation.

3.3 Location Requirements

You must be physically located within the Commonwealth of Virginia at the time of your telemedicine appointment. Auren may require:

  • Government‑issued identification

  • Proof of Virginia residency

  • Real‑time location verification

Failure to verify identity or location may result in denial or termination of services.

3.4 Limitations of Telemedicine

You acknowledge that telemedicine:

  • May limit the provider’s ability to conduct certain physical examinations

  • May not be appropriate for all clinical conditions

  • May require referral for in‑person care

3.5 Emergencies

Telemedicine is not intended for emergency medical situations.

If you are experiencing an emergency, call 911 or seek immediate medical attention.

4. Medical Cannabis Disclosures (Virginia Cannabis Control Authority Compliance)

Auren and its affiliated physicians comply with all requirements of the Virginia Cannabis Control Authority (CCA) and applicable Virginia law, including but not limited to:

4.1 Bona Fide Provider–Patient Relationship

A medical cannabis written certification may only be issued after:

  • A legitimate provider–patient relationship is established

  • A comprehensive review of medical history

  • A clinical assessment of qualifying medical conditions

  • Verification of identity and residency

4.2 Qualifying Conditions

Virginia allows medical cannabis certification for any condition the physician determines may benefit from cannabis therapy.

Patients must provide complete and accurate medical information.

Providing false or misleading information may result in denial of service and may constitute a violation of Virginia law.

4.3 No Guarantee of Certification

Payment to Auren is for the evaluation, not the issuance of a certification.

A certification is not guaranteed and is issued solely at the discretion of the evaluating physician.

Refunds are not provided based on clinical outcomes.

4.4 Registration Requirements

Virginia no longer requires mandatory patient registration; however:

  • Patients must maintain valid documentation of their written certification

  • Patients must comply with all CCA rules regarding possession and use

Auren is not responsible for dispensary access issues, state system changes, or regulatory updates.

4.5 Federal Law Notice

Medical cannabis remains illegal under federal law.

Patients assume all risks associated with possession, use, and compliance with state law.

Auren does not provide legal advice.

5. Patient Responsibilities and Legal Obligations

By using Auren’s services, you agree to:

  • Use medical cannabis only as recommended by your physician

  • Do not operate vehicles or machinery while impaired

  • Store cannabis securely and out of reach of minors

  • Not share, sell, transfer, or divert cannabis to any other individual

  • Comply with all Virginia possession, purchase, and usage limits

  • Seek emergency medical care when appropriate

Misuse of medical cannabis may result in termination of services and, if required by law, reporting to appropriate authorities.

6. Information We Collect

Auren may collect the following categories of information:

6.1 Information You Provide

  • Name, contact information, date of birth

  • Medical history and qualifying condition information

  • Identification documents

  • Telemedicine communications

  • Appointment requests and messages

6.2 Telemedicine‑Specific Information

  • Audio and video communications

  • Images of identification documents

  • Clinical documentation

  • Electronic medical records

6.3 Technical Information

  • IP address

  • Device type

  • Browser type

  • Pages visited

  • Usage patterns

Auren does not sell personal information.

7. Cookies & Analytics

Auren may use cookies, analytics tools, and similar technologies to:

  • Enhance website and telemedicine functionality

  • Improve security

  • Analyze usage patterns

You may adjust cookie settings through your browser.

8. Use and Disclosure of Information

Auren may use or disclose information to:

  • Provide telemedicine and in‑person services

  • Facilitate physician evaluations

  • Verify identity and residency

  • Communicate with you

  • Improve operations and security

  • Comply with legal or regulatory obligations

Information may be shared with:

  • Licensed physicians

  • Telemedicine technology vendors

  • Service providers

  • Government authorities, as required by law

All recipients must protect information and use it only for authorized purposes.

9. Data Security

Auren implements administrative, technical, and physical safeguards to protect information.

However, no method of electronic transmission is completely secure.

Use of Auren’s websites and telemedicine services is at your own risk.

10. Social Media Use

Users may not post:

  • Personal health information

  • Unlawful, defamatory, harassing, or inappropriate content

Auren may remove content or restrict access at its discretion.

11. Intellectual Property

All content on Auren websites, telemedicine platforms, and social media pages is owned by or licensed to Auren and protected by applicable law. Unauthorized use is prohibited.

12. Third‑Party Links

Auren is not responsible for third‑party websites, content, or practices.

13. Limitation of Liability

To the fullest extent permitted by law:

  • Auren is not liable for damages arising from use or inability to use its websites, telemedicine platform, or services

  • Your sole remedy is to discontinue use

14. Amendments

Auren may amend this Policy at any time.

Amendments are effective upon posting.

Continued use constitutes acceptance.

15. Arbitration and Governing Law

All disputes arising from or relating to this Policy, Auren’s services, or telemedicine evaluations shall be resolved through binding arbitration, except for matters eligible for Virginia small‑claims court.

This Policy is governed exclusively by the laws of the Commonwealth of Virginia.
