How to Qualify for Virginia Marijuana Card

Virginia's medical marijuana law has been a long time in the making. In 2015 an original affirmative defense law was passed for intractable epilepsy. It wouldn't be until 2018 that the Virginia lawmakers would greatly expand upon that law, and on March 9, 2018 Gov. Ralph Northam signed HB 1251 which allows doctors to recommend CBD or THCA cannabis oil for any condition.

Effective July 1, 2019 with the passage of SB 1557 the program has been expanded to allow for the creation of a diverse range of cannabis products with varying degrees of tetrahydrocannabinol, or THC. Patients that qualify for medical marijuana treatment in Virginia will receive an "affirmative defense certificate," also referred to as a "patient registration certificate." The patient registration certificate ("card") can be used to provide an affirmative defense for possession as well as granting patients access to a pharmaceutical processor - the name Virginia has given medical marijuana dispensaries. 

 

How to Qualify For A Medical Marijuana Card in Virginia

In order to qualify for a Virginia Medical Marijuana Card so you can legally purchase medical marijuana from one of the dispensaries - once they are open - you must fulfill the following qualifications: Be diagnosed with a qualifying medical condition; Have the official written certification from a Virginia licensed physician; and Be a Virginia resident with proof of residency (VA Driver’s License or VA State ID card).

How to Get Approved for a Virginia Medical Marijuana Card ​

If you have previously been diagnosed with a qualifying condition, or believe you currently suffer from one, you are most-likely eligible for a Virginia Medical Marijuana Card. The next step in the process is to find a compassionate Doctor to review your condition(s) and if appropriate, recommend marijuana as part of your treatment plan.

 

Although Virginia does not require physicians to register with the state or obtain certification to recommend Medical Marijuana, all of our Doctors have taken the time and made the effort to expand their current knowledge base to include the most recent research and studies through Continuing Medical Education coursework.

 

Once you've identified the Doctor you wish to see, you will need to schedule an in-person physical evaluation. At the appointment, you and your Medical Marijuana Doctor will likely discuss your condition, as well as your medical history. Please note, that it is always helpful for the doctor to have access to your medical records, if available.

 

If your Virginia Medical Marijuana Doctor is able to confirm your qualifying condition, and believes medical marijuana is an appropriate treatment option, you will receive a signed certification from the Virginia Marijuana Doctor recommending medical marijuana and or medical marijuana products as part of your treatment plan. This signed recommendation will then be submitted to the Virginia Department of Health Professions along with a $50 registration fee.

 

The State will process both the recommendation and fee within 7-10 business days, you will be added to the patient registry and receive your Virginia Medical Marijuana Identification card via the mail. At the appointment, you and your certified Marijuana Doctor will discuss your medical condition(s) and treatment history. It is helpful for your Virginia Marijuana Doctor if you can bring any relevant medical records documenting your qualifying condition. The doctor's signed recommendation, with the aid of our Physician support staff, will then be submitted to the Virginia Department of Health Professions. You will be responsible for the state’s $50 registration fee. Once you have paid your fee and the state has received your Marijuana Doctor’s certification, you will be entered into the patient registry. After your submission, you will receive your Virginia Medical Marijuana card in the mail.

 

What Information and Forms are Required When a Patient Applies for a Medical Marijuana ID card?

The following are required when submitting your application:

• The application form

• The completed Physician Written Certification

• Photocopy of your Virginia issued driver's license or state ID, please be aware that your name and address on your application form must match what is listed on your Virginia driver's license or ID

• The nonrefundable $50 application fee.

How To Find A Medical Marijuana Doctor In Virginia
