Virginia Recreational Marijuana Sales Will Launch at the End of 2026 at the Earliest

Virginia is moving closer to legalizing marijuana sales for adults, but recreational marijuana is still not available for purchase at dispensaries. The only way to currently purchase marijuana from dispensaries in Virginia is with an active medical marijuana card.


Lawmakers are working on creating a regulated retail market for adult marijuana use. According to House Bill 642, recreational marijuana retail sales in Virginia will not begin before November 1, 2026, and the actual date could very likely be later depending on how the legislation progresses. So, for the foreseeable future, a medical marijuana card is still required to purchase products at dispensaries.


What’s Happening With Recreational Marijuana in Virginia

Possession and personal use of marijuana are legal for adults 21 and older. Adults can legally possess small amounts of marijuana and grow a limited number of plants at home. However, there is currently no legal way to purchase recreational marijuana from dispensaries. House Bill 642 aims to establish licensed recreational dispensaries and a regulated market, but this will not happen until at least late 2026.


Until retail sales are legal, the only way to access marijuana legally in Virginia is through the medical marijuana program.
