Virginia marijuana laws can be confusing. The state allows adults 21 and older to possess marijuana, but recreational retail sales are not yet available. At the same time, Virginia has a medical marijuana program that allows qualified patients to purchase regulated marijuana products from licensed dispensaries.
Understanding what is legal, how the medical program works, and what restrictions still apply can help patients follow Virginia's marijuana laws.
Is Marijuana Legal in Virginia?
Yes. Adults 21 and older can legally possess up to one ounce of marijuana for personal use under Virginia law. Adults can also grow a limited number of marijuana plants at their primary residence when they follow state requirements.
However, legal possession does not mean recreational marijuana can currently be purchased from a retail store.
Virginia's adult-use retail market is scheduled to begin no earlier than July 1, 2027. Until recreational sales begin, you must have an active medical marijuana card in order to purchase marijuana at dispensaries in Virginia.
How Does Virginia's Medical Marijuana Program Work?
Virginia's medical marijuana program allows qualified patients to obtain marijuana when a medical marijuana doctor determines that it is appropriate for their condition or symptoms.
One of the most important things to know about Virginia's program is that there is no set list of qualifying conditions. Meaning any condition can qualify for medical marijuana if a medical marijuana doctor believes it could help!

How Do You Get Medical Marijuana in Virginia?
Getting your marijuana card is a simple process. The first step is scheduling an appointment with a licensed Virginia medical marijuana doctor - that’s where we come in!

Where Can Virginia Patients Buy Marijuana?

Can You Use Marijuana Anywhere in Virginia?

Additional restrictions can apply on school property, federal property, and other locations where marijuana use or possession is prohibited. Property owners, landlords, employers, and other organizations can also have their own rules regarding marijuana use.

Can You Drive After Using Marijuana?
Virginia law prohibits driving while under the influence of marijuana. Having a medical marijuana certification does not provide an exception to Virginia's impaired-driving laws.
Patients should not drive after using marijuana, even if they do not feel impaired. If you use marijuana, arrange for another form of transportation or wait until you are no longer using it before driving.
Virginia also restricts marijuana consumption inside vehicles on public highways. These restrictions apply even when the marijuana was legally obtained through the medical marijuana program.
When transporting marijuana after a dispensary purchase, patients should keep products properly packaged and stored rather than leaving open or accessible marijuana in the passenger area of a vehicle. Also, always have your medical marijuana card on hand.
Are Medical Marijuana Patients Protected at Work?
Virginia provides certain employment protections for certified medical marijuana patients. In general, an employer cannot take adverse action against an employee solely because they are a certified medical marijuana patient or legally use marijuana under the state's program.
However, these protections have limits.
Employers can maintain workplace safety policies and prohibit employees from being impaired while working. Certain jobs, such as commercial drivers and other safety-sensitive positions, are also subject to federal regulations or other requirements that can restrict marijuana use.
A medical marijuana card therefore does not automatically override every workplace drug policy or federal requirement. Patients who have concerns about their employment should review their employer's policies and understand any federal or industry-specific rules that apply to their position.
Can You Travel With Medical Marijuana?
Patients should use caution when traveling with marijuana.
Virginia's medical marijuana laws do not override federal law or the laws of another state. Marijuana can remain prohibited on federal property, including military bases and other federal locations.
Traveling across state lines can also create legal issues because marijuana laws vary between states. A Virginia medical marijuana certification does not automatically allow you to possess or transport marijuana in another state.
Before traveling, patients should check the marijuana laws in both Virginia and their destination state. Some states recognize out-of-state medical marijuana certifications, while others do not, and each state can have its own rules about which products and amounts are allowed.
The Transportation Security Administration (TSA) has also updated its guidance to indicate that medical marijuana may be permitted in carry-on and checked luggage under certain conditions. However, this does not override federal or state laws, and TSA screening procedures, airport policies, and destination laws can still affect whether traveling with marijuana is allowed. Patients should review the rules before flying and carry their written medical marijuana certification and valid government-issued ID.
What About Marijuana and Gun Rights?
Marijuana and firearm laws can involve both state and federal requirements.
Changes at the federal level in 2026 have created new rules concerning the restoration of firearm rights for certain individuals with marijuana-related restrictions. However, these changes do not mean that every medical marijuana patient automatically has the right to purchase or possess a firearm.
A medical marijuana certification and firearm rights are separate legal issues. Other federal and Virginia restrictions can still apply depending on a person's circumstances.
Patients with questions about their individual firearm rights should speak with a qualified attorney who understands current federal and Virginia law.
When Will Recreational Marijuana Sales Begin in Virginia?
Virginia's recreational marijuana market is not open yet.
Adults 21 and older can legally possess marijuana within the state's limits, but recreational marijuana sales have not started. The earliest date currently established for adult-use retail sales is July 1, 2027.
This is the earliest possible start date, not a guarantee that recreational dispensaries will open on that exact day.
Until adult-use sales begin, the medical marijuana program remains the legal retail pathway for qualified patients who want to purchase regulated marijuana products from Virginia dispensaries.
